General Conditions of Purchase
1. General
The Terms and Conditions set out below have been drafted by Magnolia Trendy SL (hereinafter, MAGNOLIA TRENDY) to provide users of the website www.magnolyacollection.com with clear, understandable, unequivocal and truthful information on the conditions that regulate the sale of our products through our website, on a permanent, easy and free basis.
To purchase products through the website www.magnolyacollection.com, the user must read and accept these General Purchase Conditions. The purchase process cannot be completed without their acceptance.
2. Responsible for contractual offers
Users are informed that the party responsible for the sales offers made on the website www.magnolyacollection.com is Magnolia Trendy SL (MAGNOLIA TRENDY), with CIF number B-01.494.046, and with registered office in Spain, calle Baiona, nº 47-2º Dcha., CP 01010 Vitoria (Álava) and email address www.magnolyacollection.com.
3. How to buy?
Registration is not required to make purchases through the website www.magnolyacollection.com. Users can select the product(s) they wish to purchase, and once their purchase is accepted, they will be added to their "Shopping Cart."
On the home page of the website www.magnolyacollection.com there are several sections corresponding to the different types of products that can be purchased at any given time.
The user must select the product they wish to purchase, where they can view detailed information about it:
- Product features
- If applicable, available sizes
- Price
- In case of offers, the date on which the offer will end
- The corresponding taxes included
- Shipping costs
Once the product has been selected, the total price (including taxes and shipping costs) must be paid through the "Shopping Cart." Payments can only be made through PayPal, after which you will be redirected to PayPal's website from ours. Any charges incurred through the payment method used will be the sole responsibility of the buyer.
By accepting the purchase and completing the process, a sales contract is established between the user and the company under these terms and conditions. These sales contracts are formalized only in Spanish.
Once the purchase process is complete, the purchase will be confirmed via email. The email will also contain a product description, including its features, price, taxes, and shipping costs. The product will not be shipped until payment has been received by the purchaser.
In any case, the invoice or document proving the commercial transaction will be delivered to the customer along with the purchased item.
4.- Geographical scope of the offers
The product offering on the website www.magnolyacollection.com is limited to Spain only, so purchases cannot be made by users residing outside of this country.
5. Shipping the product
Products purchased through the website www.magnolyacollection.com will be shipped via a courier company, always to the address provided by the user. MAGNOLIA TRENDY will not be liable for delays or non-delivery of products resulting from errors by the buyer when providing the shipping address.
Products will be delivered according to the courier company's schedule. If the user is absent from their home at the time of delivery, they must contact the courier company to arrange a new delivery date and time. MAGNOLIA TRENDY will not be liable for delays due to the user's absence at the time of attempted delivery. Therefore, to avoid these types of problems, we recommend that users provide a delivery address where they are available to deliver the product.
Purchases made through our website will be delivered to customers within an average of approximately 4 business days.
Notwithstanding the provisions of the preceding paragraph, the delivery times indicated are indicative and may vary depending on the destination or due to insufficient stock in our warehouses or with our suppliers. In any case, the maximum time to process the order will be 10 business days from the day following the purchase date.
When the user receives the item purchased on the website www.magnolyacollection.com, they must check that it corresponds to the item purchased, that it is in perfect condition, and that it has not been damaged during transport.
If the product received does not match the one ordered, the user must inform MAGNOLIA TRENDY using the means indicated in these terms and conditions (next paragraph). The product received in error will be removed, and the product actually ordered will be sent to the user at no cost.
If you detect any such incident, you must immediately notify the courier, who will note it on the delivery note. Furthermore, you must notify MAGNOLIA TRENDY within 24 hours of receiving the item by sending an email to info@magnolyacollection.com.
Any costs arising from failure to report the incident in the specified manner and timeframe shall be borne by the user.
6. Prices, taxes and expenses
The prices of the products offered through our website are shown in euros only. The final amount payable by the user will appear on each product page and will always include Value Added Tax (VAT) at the current rate, as well as any other applicable taxes.
However, for purchases made from the Canary Islands, Ceuta, and Melilla, VAT will be deducted from the price of the products, but applicable taxes and, where applicable, tariffs or customs fees will be added, which will be the buyer's responsibility.
Buyers from the Canary Islands, Ceuta, and Melilla must contact MAGNOLIA TRENDY before making their purchase to confirm the final price of the item(s) they wish to purchase, and to be informed of the final price, including any applicable taxes. To this end, please send an email to info@magnolyacollection.com.
Prices do not include shipping costs, which will be €5.90, an amount that must be added to the price of each product purchased by the buyer.
MAGNOLIA TRENDY reserves the right to modify the products offered on this website, as well as sales prices and other conditions or promotions, at any time and without prior notice.
7. Failure to execute the contract and replacement of the article
If MAGNOLIA TRENDY is unable to execute the purchase contract with the user due to the unavailability of the requested item, we will inform you of this unavailability before finalizing the purchase, on the product page itself and, in any case, by email once we receive your purchase request. If this has not been communicated and the user has purchased a product that is unavailable, they may recover the amount paid as soon as possible and, in any case, within a maximum period of 30 days.
However, before proceeding with the return, in the best interest of the user, we will offer the option of sending an item with similar characteristics or of higher quality, at no additional cost.
In this case, the user may exercise their right to withdraw and cancel the order under the same terms as if it were the item initially ordered, without being liable for the direct costs of the return.
8. Product Warranty
All products supplied by MAGNOLIA TRENDY come with the guarantees required by current consumer and user regulations, particularly Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for Consumers and Users and other complementary laws.
MAGNOLIA TRENDY is not a manufacturer but rather operates as a seller. Therefore, the contractual warranty offered is that specified by its manufacturer, in accordance with the provisions of the aforementioned Royal Legislative Decree 1/2007.
To make use of the warranty, it is essential that the user retains the document or proof of purchase provided by MAGNOLIA TRENDY, as well as the warranty certificate (for costume jewelry products only).
In accordance with the provisions of Article 116 of this Royal Legislative Decree 1/2007, users are informed that the photographs of the products offered are for illustrative and indicative purposes only and may differ from the original. The descriptions and images of the items offered through the website www.magnolyacollection.com are not contractual but are merely informative.
If the item develops any defect or fault during the warranty period, please notify MAGNOLIA TRENDY immediately by sending an email to info@magnolyacollection.com so that we can address the issue as quickly as possible.
MAGNOLIA TRENDY will not assume any liability if the user has acted freely without the knowledge or authorization of the company to repair the incident, and any costs or damages will be borne by the user.
The warranty does not cover defects, flaws, damage, or imperfections in the products that are due to misuse, negligence, or normal wear and tear.
In any case, the warranty conditions and exclusions are those established by each manufacturer of the products offered through our website.
9. Right of withdrawal and return of products
The buyer has the right to terminate the contract (return the purchased item) by notifying the other contracting party (MAGNOLIA TRENDY) within the period established for exercising this right, as indicated in this section, without needing to justify his decision and without any penalty.
Exercising the right of withdrawal will not entail any costs for the consumer or user. However, in accordance with the provisions of Article 101 of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for Consumers and Users and other complementary laws, the buyer will be responsible for the costs of returning the purchased item.
In accordance with Article 71 of Royal Legislative Decree 1/2007, the user has seven business days from receipt of the item to exercise their right of withdrawal and return the purchased item.
To return the purchased product or exercise the right of withdrawal, the buyer must inform MAGNOLIA TRENDY by sending an email to info@magnolyacollection.com. In this case, MAGNOLIA TRENDY will respond by email, informing them of the steps to follow for returning the product.
In the event that the user has exercised the right of withdrawal, both parties must reciprocally return the services that were the subject of the contract, with their fruits and the price with interest, except for the exceptions provided for in the Civil Code.
Once the user has exercised their right of withdrawal, MAGNOLIA TRENDY will refund the sums paid by the user without withholding any expenses as soon as possible and, in any case, within a maximum period of 30 days from the withdrawal.
Without prejudice to the above-mentioned right of withdrawal, in accordance with the provisions of Article 102 of Royal Legislative Decree 1/2007, it shall not apply, among others, to contracts for the supply of products made according to the consumer and user's specifications or clearly personalized or which, by their nature, cannot be returned or may deteriorate or expire quickly.
Accordingly, we inform users that for obvious hygiene reasons, costume jewelry purchased through the website www.magnolyacollection.com cannot be returned.
Product returns
If the user returns the item received, whether as a result of exercising the right of withdrawal or for any other reason reflected in these purchase conditions, they must do so in its original packaging, unopened and unused, along with any accessories and other documentation, and must be in perfect condition so that MAGNOLIA TRENDY can put it back on sale.
In the event that the product is returned, the amount paid will be refunded using the same method used by the customer to pay for the product.
10. Security
MAGNOLIA TRENDY has adopted the maximum security measures available. However, since payment is accepted only through PayPal, when you are redirected to the website, you are connected to a secure PayPal server that uses an SSL (Secure Sockets Layer) protocol, so that the information is transmitted encrypted.

12.- Legal notice, privacy policy and data protection
MAGNOLIA TRENDY informs the buyer that acceptance of these General Conditions of Purchase implies acceptance of the conditions described in the legal notice and privacy policy incorporated at the bottom of each page on our website.
Notwithstanding the foregoing, and in compliance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, the buyer is informed that by making purchases through our website, he/she declares that he/she has been informed and gives his/her consent for his/her personal data to be included in the file called "Clients", previously notified to the Spanish Data Protection Agency, for which Magnolia Trendy SL (MAGNOLIA TRENDY) is responsible, and to be used for the proper maintenance, development, fulfillment and control of the contractual relationship with the client, for the sending of the order or purchase made and the services requested, as well as to send by post, email or other equivalent means of electronic communication (SMS, MMS, fax, etc.) commercial information about our products, offers and news in the field of textiles, accessories and jewelry.
In any case, the customer may express their refusal to receive the commercial information indicated in the previous paragraph by sending us an email to info@magnolyacollection.com.
The company's files, premises and processing systems have the necessary technical and organizational security measures, as required by Article 9 of the LOPD and Title VIII of the RLOPD, to guarantee the security of personal data and prevent its alteration, loss, processing or unauthorized access.
We also inform you that you may exercise your rights of access, rectification, erasure, and objection, as expressly recognized by the Data Protection Act (LOPD), by submitting a written and signed request to MAGNOLIA TRENDY by sending an email to info@magnolyacollection.com, always enclosing a photocopy of your ID. If your data changes, you must notify us at the same address. The company declines all liability should you fail to do so.

15. Jurisdiction
For any controversy or conflict that may arise between users of the website www.magnolyacollection.com and MAGNOLIA TRENDY, the parties expressly agree to submit in all cases to the jurisdiction of the Courts and Tribunals of Spain, with jurisdiction being those corresponding to the buyer's domicile.
